Do i owe any additional royalties when using the APEX integration in UE4?

I realise this may be one for an email to nVidia themselves, but it’s probable Epic already know the answer.

I’d been looking into how I (as a non max/maya) user might be able to use apex clothing and found the nVidia standalone clothing program on their developer site.

On going to the download I see that the Apex EULA says that once all your physics based applications combined have reached a total gross revenue of $100,000 then you’re forbidden from using the Apex tools (I presume what they actually mean is you have to purchase a licence to continue using them, but it doesn’t make that clear as far as I could see).

So, is Epic the end user since they have integrated physx/apex into the engine, or are we the end user for agreeing to use the tools (which seems more likely) and therefore would then owe money to nVidia presuming our combined UE4 releases total the $100,000+ gross revenue?

And if that is the case, do you know what sort of cost that would be?

The Nvidia royalty doesn’t apply to using APEX with Unreal.

On an unrelated note, since I gather from other posts etc. out there you’re one of the legal team at/for Epic perhaps it would be good to get a developer tag (or legal team tag?) added to your name so people know you are working on behalf of Epic.

I’ll ask the folks that know about such things. I looked at Tim’s account and it didn’t look like he had a tag, but I guess he’s well known independently. Maybe the answer is that I work hard to make myself independently well known.
