Is it legal to make a game without paying people because of patent

If I want to develop a game I know u would have to give royalties or a service charge but, Could I freely develop a game without the problems of patents and other things that would make anyone say that I cannot create a game by law because someone patent game and I have to pay them because I decided to make a game/or make a game.)

Don’t worry guys I already have my answer this question was not constructed properly I think. But the other question I ask I did got my answer.

Just wanted to clarify, the subject of making a game that infringe on IP or utilizes patents that a developer has no right in, or material that is not owned by the developer, or has permission of use from the author (Art, music, even story) is illegal in most cases.

For instance, you cannot make a game about Megaman because the IP is owned by Capcom, however you can make a game called Megaboy (if the name is not registered in an IP) that has similar mechanics and utilizes different assets (platforms, enemies, level layouts, UI, etc).

In some cases such as fan made games, if an IP is altered (utilizing mods) then you as a creator are free to utilize the tools and assets to modify the game creatively as long as you are not profiting from it (if you are royalties should be payed to the IP owner). Other cases has seen games seeing a remake by fans only to be shutdown by legal action by the IP owners.

And just to throw this out there, when you develop a game on the Unreal Engine, you will need to pay 5% of your sales if you make 3000 usd or more in revenue per product per quarter.
