What kind of property rights does Epic Games have on the imagery within their games?

Im making an accessory android app for Epic Game’s Paragon and I would like to use their imagery such as the heroes and cards. I want to sell this app comercially but I of course do not want to infringe on Epics property rights.

I think I misread your original request, that you wanted to use Paragon content for a different game/app. I see now that you want to make a kind of companion app for Paragon. You are welcome to do that, but it can’t be sold. Our rules are in our fan art/content policy.

Exactly! Its a companion app equipped with tools to help users better design their decks. Thank you for the link, it was very informative. It does leave me with a few more questions, however. I noticed that Epic allows their content on web videos monetized through advertisement. Could this extend to my application were it monetized through adverts? If not, would donations be exceptable? The application I have in mind will require a good deal of resources to develop and maintain( keeping up with new hero releases, updates, etc.) and any support from the paragon community will go a long way.

In general, no. There’s a legal difference between developing and distributing an application using the Unreal engine and showing a video of said application on YouTube.

No. The nature of your funding, in general, does not have an impact on whether you are violating Epic’s IP rights or violating UE’s EULA. If you intend to distribute your product to other people, you can’t use Epic’s content.

Probably the best thing you could do would be to develop your application and pitch it to Epic. Though very unlikely, there is always a possibility that you could negotiate a license to use their content if your application is solid and you have a good business plan.

As for donations, if the donation in no way affected app access or content (i.e. a pure donation), I would accept it.

I’m not using unreal engine at all. I’m coding the whole app myself in android studio. The only Intellectual property I would actually be using would be jpegs of the heroes and cards from paragon. Everything else will be completely home grown. I don’t know if that makes a difference. Either way I think I’ll go ahead and just make the app, put it up for free and see how people respond to it in the first place.
