Can the Publisher Pay the Royalty

I funded the development of a small PS4 game and will be publishing it under my company. I offered to pay the Unreal royalty for my developer. Is this acceptable under the standard terms or do I need a custom license? The reason I ask is that the current intent to release form is very developer centered as is the royalty report.

The simplest solution is for you, the publisher, to take a license under the EULA. Until that happens, the developer will be contractually responsible for the royalty fees. In that sense, it is your game being released. And presumably you own the game since you paid for the developer.

One more question for you. If I publish the game on PS4 and Xbox One but they publish it on PC. Do we need to combine sales for quarterly royalty payments? Or would they pay royalties solely on the PC version and I on the combined Xbox/PS4 sales?

It’s ok to treat different SKUs as different products from a royalty reporting standpoint.
